Extra Payment May Affect Your 2011 Taxes

Military retirees 2011 tax statement (1099R)  includes income from 13 payments for 2011 instead of the expected 12 payments. This isn’t a mistake. The pay schedule for military retirees changed in mid-2011 because of the 2011 National Defense Authorization Act.

DFAS now pays military retirees on the first day of the month. When that day is a weekend or national holiday, we must move the official pay date to the previous business day.

As a result, the payment originally scheduled for Jan. 3, 2012 was issued Dec. 30, 2011.

This means you received a total of 13 payments in 2011. The first was on Jan. 3, 2011 and the last on Dec. 30, 2011. This may increase your tax liability.

We realize some financial institutions credit members’ accounts before the official pay date. If your credit union is one of them, perhaps you always received a payment at the end of December.

That’s a nice benefit, but it does not affect your tax liability. The IRS bases taxes on when DFAS issues the pay (the official pay date), not when a bank posts it to your account.

For example, DFAS issued your December 2010 pay on Jan. 3, 2011. But even before the change in the law, some credit unions credited member accounts on Dec. 30, 2010. Because the official pay date was Jan. 3, the IRS treats it as taxable income for 2011.
This year, to comply with the new law, the official Jan. 3, 2012 pay date moved to Dec. 30, 2011. That makes it taxable income for 2011.

Because Jan. 1 is always a federal holiday, going forward we will always process your pay in December. So in 2012 and beyond, you will receive the normal 12 pay checks.

The following payments are affected by the pay schedule change:

  • Retired Pay
  • Concurrent Retirement Disability Pay (CRDP)
  • Combat Related Special Compensation (CRSC) — tax free

Annuity Pay is NOT affected by this change.

  3. This caused a significant increase in my 2011 taxes by about $1200 since I am still working – this include some of the hated AMT charges! I am furious with Congress meddling with the stability of established systems. I am ready to vote for anyone except the incumbents.

    What I don't understand is why the automatic increased tax liability per se. Yes, I understand added income means more taxes and thus "more liability" but there was also additional federal and potentially state withholding. If you were properly withholding I think it would be close to wash. I think that's why they say "may increase." Jump into another bracket, maybe more money subjected to AMT but relatively minor. True?
    Additionally, we got 13 checks, so it isn't like we didn't get the money. They want to pay me 15 months of retirement pay next year, I'll gladly pay the extra taxes. I'm not in a 100% bracket, so bottom line I have more money.

      We can live with it as Chief A. said, but it is not minor to everyone. For anyone who is still working and using savings to help kids in college, this "paper change" can very well cause them to go into a new higher tax bracket, which it did. Withholding the correct amount does not necessarily prevent paying higher taxes if at the end of the year, you are surprised by a sudden jump to the bottom of the next higher tax bracket. It would have been nice to have been told at the start of the year vs the end of it. E. Miller

      We retirees joined with the assurance that we would get the benefits (pay) for what we earned, not by 'sucking it up' or 'getting over it'. Democracy means to much to America to just let thing go, chief a. I am an American taxpayer who has a voice and a vote. You exercise yours your way and I will do likewise. I am grateful and proud to be a Free American. 'It is what it is' because of nonchelante folks who don't really give a care and just 'roll with the tide.' Our National Freedom is at stake.       After serving 22yrs of my life in the military, and 3of those in
      Vietnam, I am not grateful for what I got because I earned it,
      and no one gave me anything. So why should I suck up on what
      the government has done to us veterans. Yes I know there is
      nothing we can do about it because the generals will not fight
      for us because they do not want to loose their position or rank,
      so we have to deal with what we have. That still does not mean
      that the government is always using us to help lower the deficit
      but freezing cola at times and getting rid of veteran programs,
      and charging us for health care.

      You got the money and paid the withholding on it like any other check. This is a meaningless accounting drill for 95% of retirees. To get worked into a lather over it is silly and indicative of a lack of understanding.
      Hate politicians all you want, but some of these posts are from people just spring-loaded to hate so before opening their minds and trying to understand what this is.
      This is an accounting drill to have money paid on or before it's owed the retiree when a holiday interferes. The response should be — "about time" but we largely get the opposite reaction. Again, you got credited and actually received one additional pay period in 2011 and now some MIGHT pay the additional taxes if it has tax bracket implications. NOT a big deal for one month.

    As for voting them out of office who exactly is them? Do you know exactly who approved this change? Also, remember alot of these changes were approved by the prior administration. Bush was the one who got us into this messed up economy. I might not have voted for Obama but he stepped into a mess when he was elected President. He has been trying, but it is going to take more than 1 term to get this country back on track.

I don't know about you, but I did not get 13 paydays in 2011 nor did I get 11 or 13 in 2010. We are being screwed out of an actual check by "Somebody"!!! Seems like every president is soo willing to blame "the mess" on the previous administration. Wake up America. We need real people ingovernment and NOT professional politicians anymore. And a note to CHIEF A: I am grateful for what I get but I EARNED every damn cent of it with 45 months in Vietnam and 22 years in the USAF.

      vote them all out. Them is all Senators/Congressmen (DEMS and GOPs). They do NOT want to work in congress on the bills that would help us; i.e., they wait til the last minute every year on the budget vote and then hold us hostage. They announce a vote, pizza is brought in and they leave right after pizza is consumed and say they will vote on the next day. I'm sorry, until they vote, they do NOT leave the capital grounds. We pay them to work — not to eat. No vacation/no holidays — until their jobs are DONE with respect to voting on time sensitive matters such as the Budget. Fed up? Oh, you bet I am. I'm 66 years old and tired of being kicked around by government. They will NOT vote term limitations — because it would hurt 'them' — so referendum is the way to go in each state at the general election. I know we can get that passed. People have to get off their duffs and present that referrendum to each State to put on the ballot and then watch the fur fly. LOL

        Please people, get the facts before spewing FUD! Fannie and Freddie does not make mortgages, period. They can't by law. Fannie and Freddie is in the same business as the FDIC. The banks make the loans and Freddie and Fannie insures the loans, the same as the FDIC insures your bank accounts. The real problem with mortgages is taht the banks bought and sold mortgages loans that they knew were useless. In as much, Freddie and Fannie had to make those loans good. The problems with mortgages were the banks and the banks alone. Now, for all of you who say they should let them fail, I say would say the FDIC should let them fail and you lose your banking accounts. Did I see one Hand??? Lol!!

How about mortgages which the banks were forced to lend to people who were not qualified, started during the Clinton years along with Dodd/Frank, as principal sponsors of the Community Re-investment Act.     Another present from your Federal Government. I had my taxes done by Christmas. When I received my 1099-R, I immediately saw where my 2011 taxes, federal and state, went up. I also see where this extra 2011 income is taxed at a higher rate than most of my other income as it gets taxed in the next higher bracket. It just gives more of my money to the government. Were I a conspiracy theorist, I would think that was intentional, BUT THE GOVERNMENT IS JUST NOT THAT SMART!!

    We received an extra pay check in 2011, that's great! But why? Maybe so they could make it look like we were getting more as well as a cost of living increase??? You know the big 3….. whatever % . They just took it all back by moving our Jan. Pay check to the end of Dec. Slick move!!

    I Love My Country and what it stands for, But I don't Love what it is turning into. I HATE the so called Government that is running our Country and is destroying it from within. I DO NOT trust any of the SOB's. Some people want to blame Obama, some want to blame Bush. I say it is all of our elected officials and US that are to blame. We elected some of them and they brought their friends and Buddies on board, some we knew about and some we didn't. The Big question is How do we fix it? The IRS, that was supposed to be voluntary in the beginning, is now the Gestapo of the USA. Try to tell them that, see what happens. Where does all of our taxes go that they collect religiously? Does it go to things that help our Country? If so, WHAT??? I served over 20 years, just like many of you have. How do you feel about that now???

    What an "F—-ing" mess!!! How do we fix it! I am disgusted, depressed, and don't even want to turn on the TV news anymore. Our new generation of leaders are smarter, better educated and don't have a CLUE! Where does that leave US?

    Pets. When an insurance company downgraded BLAST CELL CANCER OF LYMPHOMA, a deadly canine cancer without chemo, to merely "an incident," capped at $5,000, with policy maximum of $13,000. it was a devastating blow on top of that of CANCER! This Master of the House, a handsome, Male, Black Labrador, even strides with a swagger knowing he is tall, lean, and all muscle perhaps, and that people always take notice of his good looks and charm. Also ATTITUDE. He strides to his chemo appts certain he is the best looking in the room!

    A gracious Colonel of our US Army Veterinary Corps was very empathetic, the oncology specialty is not common, and my guy has been in Chemo under oncology management since Nov, went into remission two weeks later, and continues with optimum prognosis, especially given the Bone Marrow Transplant option at NC State University of Veterinary Medicine at Raleigh.

    Costs are $13,000 to $16,000 without transportation by air? Pursuing grants, none from the military associations for pets in these circumstances given the statistical health benefits for PEOPLE as well?

    LYMPHOMA is "BIG TIME." Do not even think of a General Practcioner; a dog without chemo could be dead six weeks from diagnosis. Often there are no obvious symptoms of the swollen lymph nodes then detected by a veterinarian; it is a good idea to check them routinely, also for consumption of large amounts of water.

    It is heartbreaking because of the risks only 2% survive on Chemo alone;' 40% following the Bone Marrow Transplant. That math is not "happy" either. But it is much better than 2%.

    This people is the political dialogue today. Should we all be on "entitlements?" Does "earned" have any relevance? The Master of this House is ONLY six years old; he has been insured since 8 wks of age and the premium increased in Sep of 2011 from $70 to $128; he is the priority and there are charitable groups funding cancer treatment, grants. Humbling.

      Why only rertired military. Federal retired personnel received thier pay on 3 Jan 2012. Did the DFAS Center do this on thier own. It is obvious that someone had control of this, the Federal Retired was included in the same NDAA for a pay raise. Yes, it is taxable and it cost me $750.00 extra because of it. Paying taxes on two days for a full month pay doesn't add up. How can DFAS justify 12 payments in 2012, instead of 11. Some where the math will eventually even out, at the Retired Military expense.

    Really some idiot thinks they got a real extra pay day. You pay tax on the one day early pay day and you will still pay tax on 12 paydays in 2012. Write your congressman and demand that they allow a tax credit for that extra tax you had to pay without any extra benefits. Also if you are into the Social Security tax whole then you will pay an extra tax on .85% more of that phantom pay day. All in all it will cost you about 27%. You also get stung again on the tiny 3.6% COL if you are in the SS tax range. Wrirte your congressman and demand that an inflation clause be initiated to raise the SS starting point. If not due to inflation everyone wil be taxed again on SS. You paid as you put it in and you will pay as it comes out. THIS WAS A DELIBERATE SCHEME TO SQUEZE MORE TAX REVENUE FROM THE LITTLE MAN. Who could you vote for. The democrates will tax yout death and the Repubicians will take away every benefit that the little man gets

    Hey guys. If you want to blame someone, blame Congress. They passed the law not DFAS.
    This should not be a big deal for most people, since with the extra pay check came the extra withholding. Where you can be hurt, is if it takes you up a tax bracket.
    Again, blame Congress. If you have a problem with it, remember to vote next November!

And…for your information…..Everyone is already screwed…including your children, your grandchildren and your grandchildren's grandchildren (if the world lasts that long)…or haven't you noticed the size of the additional national debt this president has piled on to what was already there. How can you and people like you keep avoiding the truth even when it stares you in the face!. Talk about a non-thinker. Obama's party has been doing that for you and won't quit until it controls every part of your life and mine. Wake up Arclight….for one who has light as part of your identity, there is very little being shed on what's wrong in D.C.

    I live in Idaho and was enraged at this accounting slight of hand. I am a CPA and assure you that by doing what they did, they generated more tax revenue without paying us any more. They simply paid January's pay on December 31 of the previous year thus raising the income subject to tax for 2011. All subsequent years will be paid likewise, so no, it does not wash out. 2012 has 11 payments plus the payment for January 2013 makes a total of 12 subject to tax for 2012. You only get 12 effective payments for the year, but get to pay one extra pay period for tax in 2011. Very slick. I wrote to my Congressman, Raul Labrador, and both Senators, all republicans. Only the rookie legislator, Raul Labrador, answered and agreed to action my complaint. Be assured that neither Senator Risch nor Senator Crapo will get my vote again. Let your Senators and Represenatatives know how you feel and demand action. This was total BS! Duston Rose, LTC USA (RET), Realtor, CPA

      I concur. I just did my taxes using Turbo Tax and just for the heck of it I subtraced out my Dec 30th pay. It changed my taxes by $300( I retired as an E7). This added month of pay not only added to my gross pay, it also increased the amount of my Social Security subject to taxation. I'm sure many retires got screwed a lot worse.

      Right on Colonel! My question is this! If all military retirees are paying taxes on retired pay for 13 monthly payments in 2011 while actually only receiving 12 payments, when do we get to pay taxes on 11 monthly payments while at the same time actually receiving 12 payments?       I too contacted both Senators Webb and Warner and Congressman Connelly. Rep Connelly thanked me for my letter concerning Guantanamo Bay. Sen Warner thanked me for my letter on Social Security and the COLA. Apparently their staffs don’t read the letters too closely. After following up with staff and getting bogus answers, I asked for meeting with all. None has responded or acknowledged the requests. They just don’t care.

    My fellow vets! I agree that we need change in government. My question is.
    How do we trust the next group that takes office? If we had representation that tracked the voting records of the people in office, we would have a better idea of who to vote out. l know that we have veteren organizations trying to fight the system and we should all support them. We all have legitimate gripes, but how do we as a group make a stand and fight together. Maybe we need to gather for a march on Washington to show a force of voters they are going to loose in the next election. All these elected officials have statewide offices working their campaign trail and we missed the opportunity to show a force at their so called debates. Did any of you hear them say they would fight to protect benefits for the vets? I wish we had put together a rally during SC's preliminary campaign.

    There are too many of us retirees and other vets that they effect to not make our force known in the voting booth.

    This action was nothing more than the government taking some more money from the American people. These are the same group of fools that have been messing up the economy buy not cutting back on government spending in all areas; instead they choose to cut military budgets, education and assistance to those that need it. Taxing us to death is their simple solution in trying to fix the problem. Less we forget that retirees haven’t received a cost of living increase for almost three years. It makes me wonder what the government was thinking when they signed into law back in the 70’s that took the us off the gold stand? The dollar was worth more and everything was good and the economy was balanced. Now due to the excessive money printing the dollar has dropped in value and we have the worst economy that I can remember. I think that when Election Day comes in November, no matter what party you support everybody should write in “NONE OF THE ABOVE” We need to start a third party by the people, for the people before it’s to late.

    Not only did the 13th check in 2011 boost the total of income for the year which increased tax liability; The small increase in the 2012 was not factored in. Our case only $20, but multipy that across the board, that was a great increase to the government "take."
